	bibo:abstract "Penelitian ini bertujuan untuk menganalisis konflik norma antara Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan dalam pengaturan tindak pidana pengguguran kandungan (aborsi), serta untuk mengetahui penyelesaian terhadap konflik norma tersebut.Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Sumber bahan hukum yang digunakan terdiri dari bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum sekunder berupa buku, jurnal, serta literatur yang relevan. Analisis bahan hukum dilakukan secara kualitatif melalui penafsiran dan pengkajian terhadap norma hukum yang berlaku.Hasil penelitian menunjukkan bahwa terdapat konflik norma antara KUHP Nomor 1 Tahun 2023 dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan dalam pengaturan pengguguran kandungan. KUHP pada prinsipnya mengatur aborsi sebagai perbuatan yang dilarang dan diancam dengan pidana. Sedangkan Undang-Undang Kesehatan memberikan pengecualian terhadap larangan tersebut dalam kondisi tertentu, yaitu karena indikasi kedaruratan medis dan kehamilan akibat perkosaan atau tindak pidana kekerasan seksual lainnya. Perbedaan pengaturan tersebut berpotensi menimbulkan ketidakpastian hukum dalam penerapannya."^^xsd:string;
