	bibo:abstract "Penelitian ini membahas tentang pembagian harta bersama berupa bangunan yang berdiri di tanah milik pihak ketiga, berdasarkan Putusan Nomor 2704/Pdt. G/2025/PA.Bjn dan dikuatkan dengan Putusan PTA Surabaya Nomor 84/Pdt. G/2026/PTA.Sby. Latar belakangnya adalah putusan pembagian harta bersama yang bersifat deklarator tanpa amar kondemnator, sehingga tidak bisa dieksekusi meskipun sudah inkracht van gewijsde. Situasi ini semakin kompleks karena bangunan seluas 73,5 m² berdiri di tanah yang belum dibagikan sebagai warisan, menimbulkan konflik antara hukum acara perdata Islam dan hukum agraria. Metode yang digunakan dalam penelitian ini adalah normatif-empiris dengan pendekatan perundang-undangan dan wawancara dengan Ketua Majelis Hakim Pengadilan Agama Bojonegoro. Rumusan masalah mencakup pertimbangan hukum hakim dalam menambah diktum kondemnator dan implikasi yuridis terhadap perlindungan hak pihak terkait. Hasil penelitian menunjukkan hakim mengabulkan penambahan amar kondemnator dan menerapkan Asas Pemisahan Horizontal. Ada skema amar bertingkat dengan kompensasi finansial sebagai langkah utama dan lelang sebagai langkah akhir. Namun, putusan ini menimbulkan hambatan praktis dalam lelang karena ketiadaan Sertifikat Hak Milik tanah, potensi penurunan nilai bangunan, serta risiko sengketa baru. Kekosongan norma dalam PMK Nomor 122 Tahun 2023 mengenai lelang bangunan di tanah pihak ketiga menjadi temuan penting untuk reformasi regulasi."^^xsd:string;
