PENYELESAIAN TERHADAP PENYEDIA JASA KONSTRUKSI YANG TIDAK MENYELESAIKAN SERAH TERIMA KEDUA (FINAL HAND OVER) (Studi di Dinas Pekerjaan Umum Sumber Daya Air Kabupaten Bojonegoro)

This thesis is entitled "Settlement of Construction Service Providers Who Did Not Complete the Second Handover (Final Handover)". This study aims to analyze the legal settlement mechanism for construction service providers who did not fulfill the second handover obligation, and to identify the factors causing the failure of the settlement. The research method used is a normative juridical approach with secondary data analysis and interviews with related parties. Although the project has not entered the Final Handover (FHO) stage, the service providers, namely. Several factors causing the failure of the FHO completion were identified, including: weaknesses in the initial planning and design, work implementation that did not comply with technical specifications, weak supervision, and lack of coordination with technical institutions such as the Bengawan Solo River Basin Center (BBWS). It was also found that social conditions in the field, such as issues with land owned by residents, and limited contractor capacity also contributed to this problem. This study recommends that the Bojonegoro Regency Water Resources Public Works Agency tighten the technical supervision mechanism and involve more parties in the planning process. In addition, it is important for contractors to improve their professionalism and be responsible for the quality of their work. Thus, it is hoped that construction projects can run according to expectations and meet the established standards, as well as protect public interests.
